IN CONSIDERATION for being allowed to participate in the Talking Trees Trout Derby (Event) in Cherokee, North Carolina, I agree to assume all risks for myself and the below noted minor child, for whom I have parental or guardian rights and legal responsibility.
I release the Eastern Band of Cherokee Indians (Tribe) and its assigns or agents and contractors from any liability or responsibility for injury, damages, or death resulting from any cause while attending or being an active participant at this Event.
I give my permission to the Tribe the right to take, use, reproduce, edit, photograph, record, and broadcast in any and all media formats, in whole or in part, including for commercial promotion of the Tribe and Event, my and/or my minor child or ward’s image, likeness, voice, name and biographical information in connection with the Event without compensation to me or my child/ward, and I further release the Tribe from all claims, demands, suits and liability that I or my child/ward and our successors and assigns may have for such use.
I understand that all items, including but not limited to, materials, supplies, promotions, awards and door prizes, received by myself and/or my child or ward as a participant in this Event are not warranted or guaranteed by the Tribe. Acts of God or nature that prevent optimum use of the promotional materials, prizes or awards will not be warranted or guaranteed by the Tribe. Once received by the recipient, warranty or guarantee are the responsibility of the recipient and third party redeeming or providing goods, services, or cash for the award, prizes, or promotional materials.
I understand that only minors are eligible to win the fishing contest awards/door prizes and if it is determined by the Event Organizers that I have caught any of the contest entries, my child/ward will be disqualified from receiving all awards/ door prizes. The decision of the Event Organizers is final.
I agree to supervise and accompany the minor child named below at all times throughout the Event.
